In this session, I would like to discuss the work permit application process for foreign nationals who have received an employment offer from a Canadian employer.
This type of application attracts many foreign nationals who want to work in Canada. If you have received a job offer, you can apply under this category.
First, the Canadian employer has to send a Labour Market Impact Assessment (LMIA) application to the Employment in Social Development of Canada (ESDC). When an employer submits this application, they have to prove that they have made a sufficient effort to hire a Canadian permanent resident or Canadian citizen. The government of Canada encourages the businesses and the Canadian employers to recruit for positions locally.
The employer must prove that:
- Recruitment for a local employee was unsuccessful after advertising for at least one month with multiple sources
- They have made sufficient effort to hire locally
- The job is critical to the company’s operation and development
- The business has the ability to pay the foreign worker the wage that is required by ESDC
When ESDC assesses this application, they also consider the demand for this occupation in the geographical region where business is located. If the occupation is high in demand, the likelihood of approval is much higher. For example: if specialized training is required for that occupation, the application is more likely to receive approval.
Once the application has been assessed by ESDC and approved, the employer can provide the approval for the LMIA so that the foreign worker may proceed with his or her work permit application
When the foreign worker applies for a work permit, they have to prove that they have ability and qualification, education, to perform that job for the Canadian employer. They also must prove that they have enough ties to go back to their country at the end of their employment contract.
