How to File a Canadian Visa Appeal After a Refusal

By Michael Niren September 21, 2012 (Updated March 17, 2021) 3 min. read

If you’ve received notification of a Canada visa refusal from Citizenship and Immigration Canada, it can be extremely distressing. Note that you do have options when it comes to appealing a Canadian visa refusal, however, time is not on your side. You may only have a very short window of time in which to appeal your Canadian visa refusal, even as little as 30 days. If you have been refused for immigration or had an application denied, it is very important that you act immediately.

How to Appeal a Canada Visitor Visa Refusal?

The appeal options for Canadian visa refusal are:

Sample Appeal Letter for Canada Visa Refusal

If you were denied a Canada visa you can send in an appeal letter for the government to reassess your case. We highly recommend only having an immigration professional help you with this step to avoid any possible mistakes and ensure the best chance for approval.

In an appeal letter you want to include the following:

  1. The date and address of the embassy
  2. Personal details and current address
  3. The date your Canadian application was rejected
  4. The main body of the appeal letter includes why they refused your application, why you believe that they made a mistake with their decision, and prove their decision was wrong.
  5. Travel history and previous visas
  6. Reasons why you wanted a Canadian visa
  7. Create a sense of urgency
  8. Hand Signature
  9. Include all the required documents in an attachment to the appeal letter

Appeal Options for Immigration Refusal in Canada

There are several different options available to you if you have been denied to come to Canada. You can:

It is not always easy to determine which of these options is the right one for you, particularly because it depends on several factors.

Is Appealing a Canadian Visa Refusal the Right Option for Me?

Which option for appealing against a Canadian visa rejection is right for you depends on many things, including what type of visa application it was. Did you apply for permanent residency, or did you apply for a Canadian visitor visa or study visa? Different avenues of appeal are better suited for different types of visas and personal circumstances.

You may only have as few as thirty days to appeal your Canadian visa refusal. This is a very short deadline and you must act quickly.

Appealing a Canadian visa refusal is an extremely complicated and delicate process. You will have to effectively demonstrate why your application should not have been denied and why you deserve a second chance. A licensed immigration lawyer can be your biggest asset and advantage during an appeal against a Canadian visa refusal!

I had a great experience with Andrew Diamond from The Visa Place. Andrew was very knowledgable and helped us every step of the way. When we had a discrepancy with my spouse’s Visa Andrew helped us navigate the system in the USA. He even offered to speak directly to the customs and border control officer to help us iron out the situation. Overall the experience was very good and smooth. I highly recommend Andrew and his services at The Visa Place.

I spoke with Lilly last week and she’s incredible. Very informative and you can tell she definably cares about her job. She wasn’t pushy at all and she’s there to help you figure out if this service is right for you. I’d recommend contacting VisaPlace if you’re thinkin of traveling internationally and you have questions about the different types of permits.

Extremely satisfied with the professionalism, expertise, efficiency, speed and thoroughness at which my file was managed. Fadi & Danielle are true class acts! Their response times were fantastic (especially during a high-stress period), their quality of work was phenomenal, and their willingness to go the extra mile (without hidden costs, no less!) to prepare me for my work permit interview was unmatched. I strongly recommend VisaPlace to anyone seeking legal counsel as it relates to cross-border services. Highest Regards, Krista

Very good personal experience with this law firm. I am a Canadian and had overstayed a visa in the US and received a bar. Attorneys and staff were extremely knowledgeable. I was given accurate information with no false hopes. My case was completed and approved 3 months faster than expected. Overall, very satisfied with this firm and would highly recommend them. When you are in need of immigration assistance, it can be grave and critical to get help from someone who can be trusted – this firm is certainly trustworthy and will do whatever they can to get your case approved.

EDIT: Another great experience 5 years later with waiver renewal/lifting of my bar from the US. Very reasonable fees for the challenge of dealing with US immigration during Covid and new immigration laws. Another successful outcome with only a minor snag (not related to lawfirm). My bar was lifted and I am now free to travel to the US at will. Very satisfied.
