Canadian Interest Exemptions
One common way to obtain an LMIA exemption is to fall under the category of “Canadian Interest.” To qualify, the foreign national’s employment must either:
- Benefit Canadians: Offer significant social or cultural advantages to Canada. This often involves demonstrating a strong track record of success and obtaining endorsements from experts in their field.
- Maintain Reciprocal Employment: Contribute to reciprocal employment relationships with other countries, ensuring a fair exchange of work opportunities.
Intra-Company Transferees
Another route to an LMIA exemption is through the “Intra-Company Transferee” program. This allows companies to transfer skilled foreign workers to their Canadian operations. To be eligible, the transfer must:
- Improve Business: Enhance the company’s business in Canada, ultimately benefiting Canadians.
By meeting these criteria, companies can bring in foreign talent without the need for an LMIA, streamlining the hiring process and contributing to Canada’s economic growth.
