What the 2026 midterm results mean for Canadians moving to the US

The US midterm elections on November 3, 2026 changed who controls Congress. For Canadians planning a move to the US, the news is mostly good: the routes Canadians use most are unchanged, and the year ahead may bring a steadier, more predictable system.

The short version
  • Nothing changes right away. The new Congress starts in January 2027.
  • Most immigration rules stay the same. Day-to-day immigration rules and processing are set mainly by US government agencies, not by Congress.
  • The main routes Canadians use are stable. The TN, E-2 and L-1 are built on trade agreements, treaties and long-standing law.
  • More checks and balances. Expect more oversight of immigration enforcement, which tends to mean more predictable rules over time.
  • What to do: keep planning. Canadians with the right route and good preparation are still moving to the US every day.
Does this sound like you?
  • You’ve been checking the news every day, wondering if you should wait to see what happens.
  • You’ve put your plans on hold until things “settle down,” and you’re wondering if now is the time.
  • You’re worried the rules could change halfway through your application.

What changed on election night

As of November 4, Democrats are projected to win control of both the House of Representatives and the Senate, with a few races still being counted. The new members take office in January 2027. Until then, the current Congress stays in place.

Control of Congress matters for immigration in three main ways: it writes immigration laws, it sets the budget for immigration agencies, and it oversees how those agencies work.

Key dates for Canadians

  1. Nov 3, 2026Midterm elections. Control of Congress changes.
  2. Jan 1, 2027EB-5 minimum investment scheduled to rise with inflation.
  3. January 2027New Congress takes office.

What stays the same for Canadians

RouteWhy it’s stable
TN visaPart of the USMCA trade agreement between Canada, the US and Mexico.
E-2 investor visaBased on a treaty between Canada and the US.
L-1 company transferLong-standing law that businesses on both sides of the border rely on.
Family green cardsSet by long-standing law.
EB-5 investor green cardThe new filing fees still take effect on November 30, 2026. The new fees are already final.

Most of the rules that affect your application day to day, like forms, fees, processing and border procedures, are set by US government agencies. An election result doesn’t change those on its own.

What about immigration enforcement?

Enforcement is carried out by US government agencies, such as Customs and Border Protection at the border and Immigration and Customs Enforcement inside the US. Day-to-day enforcement decisions stay with those agencies, so nothing changes overnight.

What a new Congress can do is look closely at how enforcement works and how it’s funded. More oversight hearings, questions and budget debates are expected in 2027. Over time, that kind of scrutiny usually leads to clearer, more consistent rules.

For Canadians, the practical picture stays the same. Enforcement focuses mainly on people without valid status. Canadians who travel and move the right way rarely run into problems. That means:

  • Having the right visa or status for what you plan to do in the US.
  • Carrying your documents and answering border questions calmly and truthfully.
  • Staying within the time you’re allowed, and registering if you stay 30 days or more. Our Snowbird Day Calculator can help you track your days.

What could change in 2027

Big new immigration laws are less likely. When the White House and Congress are led by different parties, major immigration bills are harder to pass in either direction. Most changes are likely to keep coming through agency rules, policy updates and court decisions.

Funding and oversight. Congress controls the budget for immigration agencies, including the agencies that process applications. That could affect priorities and processing over time.

Programs that need renewal. Some programs, like the EB-5 regional center program, have to be renewed by Congress from time to time.

The bottom line: this is a good time to move forward. Your main routes are unchanged, oversight is likely to increase, and waiting for politics to settle rarely helps. Canadians who plan carefully and apply under the rules in place are moving to the US successfully.

What to do now

1. Plan on today’s rules. Build your plan around the rules in place now, not predictions.

2. Get your documents ready. Passports, degrees, work letters, proof of funds and records take time to gather, whatever happens in Washington.

3. Have a backup route. Many Canadians qualify for more than one route. Knowing your options means a change in one area doesn’t stop your move.

4. Watch for real changes, not headlines. We’ll keep this site updated when rules affecting Canadians actually change.
