Start a business on H1B?

Asked by: 1929 views ,

I’m in the states on an H1B visa, and I’d like to know if it would be possible to start a business?

Since, as an H1B holder, your work in the U.S. is employer-specific (i.e. limited to employment with the approved employer/petitioner) and working for your company and receiving any kind of compensation for your work is strictly not allowed.

However, you are not completely prohibited from investing in a business. You may invest in a venture of your own and could possibly undertake some limited work on behalf of your venture.

This is a fine line and to err on the side of caution, I recommend that you consult with a qualified immigration lawyer to better assess your situation and find out what options you have.
