TN Visa Requirements for the USCIS – Case Study

Client’s Issue or Problem

Client had a job opportunity from the US from a well know media syndicate. The problem was, the starting date of the opportunity would be much sooner than what would be attainable under the O-1 visa category as someone with extraordinary ability or achievement.

Our Solution (Type of Visa/Action Recommended, What We Did)

Even if we were to use Premium Processing through the USCIS which guarantees a response within 15 calendar days would not be soon enough for the US petitioning company. We took the approach of dissecting exactly what the Client would be involved in. We were pleased to find out that much of what’s going to be done was involving consulting in the Client’s area of expertise.

We thereafter analyzed the offer letter, determined who the consulting was being provided to,  made some modifications which the Petitioning company was to review, put together a submission letter that showed exactly how the Client qualifies under the TN categoryof Management Consulting, and prepared the client as to the TN process.

The whole process from retention to completion was within a one week period.


The Client applied at a Port-of-Entry for TN application and was approved the period that was requested.
