New Quebec Regulations for Immigrant Investor Class Applications

New Immigrant Investor Class regulations

As of February 2, 2009, new regulations are in effect concerning applications for permanent residence under the immigrant Investor Class.

The following is a summary of the highlights of the new Immigrant Investor Class rules:

  • Waiving of interviews:  it is expected that Quebec immigration will waive 50% of the interviews [this is dependent on the completeness of the application]
    • Expected to greatly reduce backlog of applications
  • Changes to Management Experience definition:  must have 2 years of business management experience in the last 5 years (the old requirement was 3 years of experience in the last 10 years)
    • Experience no longer has to be a in a profitable business or on a full-time basis
    • Introduction of the notion of authority:  persons who hold high management positions with delegated authority will qualify (namely professionals like doctors, lawyers, and accountants will now qualify)
    • However, this professional must not be a wage earner, but actually has authority to run a business
    • Must have managed the equivalent of two full time employees (30 hours or more per week); it is also fine to have supervised 4 part-time employees
    • Employees can be family members
  • Change to Net Assets definition:
    • Spouse’s Assets:  inclusion of spouses assets in the net worth is now accepted, subject to the following:
      • The principle applicant must show as much or more than his accompanying spouse in net assets, meaning that not more than 50% of the assets must come from the spouse
      • If the principal applicant is using the spouse’s assets, the spouse must provide full disclosure of all assets
    • Inheritance:  no limitations placed on this
    • Donations:  donations must be received at least 6 months prior to the application being filed
  • Change to Application forms:
    • There is now something called 9 Essential Documents which must be filed
    • new forms will be coming out by the end of the month
  • Applications filed after February 2, 2009 will also be required to do document update in the middle of the processing of the application
  • Files for Syria are now to be sent to the Montreal selection office instead of Damascus
