Must the beneficiary of the Form I-130, be present with the petitioner at the time of filing the immigrant visa petition?

    No, the Beneficiary is not required to be with the Petitioner at the time of filing the applicaton. The application is submitted via mail. You would simply need to ensure that the Beneficiary has signed all of the required forms prior to submitting the application.
