I’m a Colombian citizen and my boyfriend is Canadian. Should we get married first and then apply for a sponsorship visa? Or, what would you recommend as the best process?

Hi and thank you for your question.

After you and your boyfriend get married, only then will he be able to sponsor you to become a Permanent Resident of Canada, assuming you both meet the eligibility requirements under Canada’s Immigration and Refugee Protection Act.

There are two application streams you and your spouse can apply for when submitting a spousal sponsorship application. The “In Canada” application and the “Outside Canada” (overseas) application.

If you to move to Canada and live here after you got married you can apply through the “In-Canada” process, or the “Overseas” process.

If you remain outside of Canada after marriage, you can only apply via the “Overseas” process.

There are advantages and disadvantages to both types of these of application streams.

With regard to your particular circumstance, it would be best to consult with an immigration expert on how to proceed on your spousal sponsorship application.
